Hi, I live around Sunnyvale, California. I have been renting an apartment since 5 years now. On 2007 they closed our Patio and put a wood board which is half covered. They covered the back wall with thick plastic sheet. Since then they did not repair it. They kept telling they would repair it. But they didn't give any written notice. Its been for 3 years. Recently in 2010 Jan we reported roaches and mold in our apartment. They came in and inspected our apartment. They said both mold and roaches are caused by us because we did not keep the apartment clean. They took picture of it. Its just because of the mold, the apartment did not look clean and in the kitchen sink there were some strains. They said everything is because of that. We used to keep the windows open during the winter on and off. But they say we did not do that. We do not have AC either. They sent 3 days notice to quit or clean. We cleaned the strains and they inspected and then did treatment for roaches. They charged us $750 for roaches. But they did not treat mold. (But we don't see any mold now. The mold were actually only around the windows and we never had this problem before during our 5 years stay even the past 2 years after they closed the patio). Now they are asking us move out for 2 weeks with all our stuff so that they can perform major repairs (I don't know what that major repair is). They did not give any notice either. I told them, its not possible but leave 2 weeks early from my lease expiration date, to accommodate them. Its an old apartment and they have history of charging tenants for repairing and reconstruction. I am afraid they may charge us for mold repair too. What should I do? What are my rights? (I know I, like other all previous tenants, won't get my 1K deposit back). But I want to protect myself from them charging us for mold repairs.... Read More »
